Capture your customers' marketing opt-in preferences

When a new customer makes an in-store purchase, it’s important that staff ask whether they’d like to join your database and receive marketing via email and SMS. Permission is required by International Law (including GDPR, TCPA, TCIA & CCPA) and our Terms of Use.


Capturing marketing consent (opt-in) means:

  • If you already use Marketing or SMS add-ons → you can immediately send campaigns and automations to those opted-in customers.

  • If you don’t yet use Marketing or SMS add-ons → you’ll be building your list now, so when you decide to upgrade, you’ll have a database ready to go from day one.

⚠️ Important: Opt-in is required
By default, customers are not subscribed to marketing. They must provide explicit consent (opt-in) before they can receive campaigns and automations through Marsello. Capturing their preferences early means you won’t miss out on future opportunities to engage them when you’re ready to start marketing.

Here are some key details to know about customer opt-in for marketing messages:

Collecting SMS Subscribers in Lightspeed eCommerce eSeries (Ecwid) with Marsello

To collect mobile numbers as SMS subscribers in Marsello, you’ll need to adjust your Ecwid settings. This includes updating your checkout settings and language settings. Step-by-step instructions are provided below.

How Consent Works in Lightspeed eCommerce eSeries (Ecwid)

Ecwid’s Newsletters consent checkbox (found at checkout and in customer profile communication preferences) applies to both email and SMS marketing.

  • If a customer checks this box, they agree to receive promotional emails and SMS messages from your store.

  • This combined consent ensures compliance with regulations but also means both channels are tied to a single opt-in step.

Compliance & Age Restrictions

  • TCIA regulations prohibit promoting to individuals under 18 years of age.

  • You are responsible for ensuring your store discourages underage visitors.

Opt-Out Requirements

It’s essential to always provide customers with an opt-out option. Marsello includes these by default:

  • Emails: An automatic “unsubscribe” link in all templates.

  • SMS: “Reply STOP to unsubscribe” included in all SMS templates.

Training Your Staff

As highlighted in our SMS Marketing Compliance Introduction and GDPR Introduction, collecting SMS and email opt-ins may require updating staff training. Ensure your team understands the correct process for signing up new customers through Lightspeed eCommerce eSeries (Ecwid).

Legal Guidance

How do customers opt in to marketing through Marsello sign-up forms?

Marsello has two different types of sign-up forms: pop-up and landing page. These form templates include a text disclaimer that informs the customer that by submitting the form, they are opting in to receive both transactional and promotional emails and SMS messages from your store.

Default text disclaimer:

*I agree to receive transactional and promotional emails and text messages (to the email address and phone number provided). Consent is not a condition to purchase. You can opt out or change your email and SMS preferences anytime.

⚠️ Important: If you are using another app for sign-up forms, you need to update your forms to also include such a disclaimer that informs the customer that by submitting the form, they are opting-in to receive both email and SMS marketing from your store.

📝 Note: Customers are always in control of their marketing preferences and can opt-out at any time. All promotional messages sent through Marsello include an unsubscribe link, allowing customers to opt out whenever they choose. Alternatively, customers can request to opt out in-store at checkout or manage their preferences online through the Marsello Customer Portal.


How do I capture customer marketing opt-in preferences in Lightspeed eCommerce eSeries (Ecwid)

⚠️ Important:

  • To use Marsello on your Ecwid online store, please enable the required sites under the Integrations page.

  • By default, customers do not accept marketing, and they must opt-in to receive marketing through Marsello.

As outlined in the Marketing Compliance Introduction, customers must give express written consent before receiving marketing emails or SMS.

There may be several updates that you need to make to your Ecwid store in order to receive full marketing opt-in consent from the customer.

The settings that you need to update are addressed in the following sections:

⚠️ Important: The below changes are vital steps towards compliance. Please follow and complete each section.

If your Ecwid store is embedded in another website platform e.g. Wix, Wordpress please update your privacy policy or any terms & conditions page that your store has to include a disclaimer that lets the customer know that by submitting their email & mobile, they are opting-in to receive both email and SMS marketing from your store.


What Lightspeed eCommerce eSeries (Ecwid) settings should I update to collect marketing consent?

✔️At checkout: Allow your customers to enter their mobile number

1. In your Ecwid admin, go to Settings > General


2. Click Cart & Checkout


3. Scroll down to the Checkout settings > Require phone number at checkout and click the toggle to turn it ON.

At checkout, allow customers to enter their mobile number by going to Ecwid admin > Settings > General. Click on Cart & Checkout, scroll to Checkout settings, and toggle “Require phone number at checkout” to ON.

4. Click Save


✔️At checkout: Edit your checkout so customers can give consent to receive marketing

1. In your Ecwid admin, go to Settings > General


2. Click Cart & Checkout


3. Scroll down to the Newsletters > Request customers’ approval for your marketing emails at checkout and make sure this setting is set to ENABLED

At checkout, enable customer consent for marketing by navigating in your Ecwid admin to Settings > General, then Cart & Checkout. Scroll to Newsletters and ensure “Request customers’ approval for your marketing emails at checkout” is enabled.

4. Update the Text Label default copy to be the following:

💬 "Subscribe to stay up to date on news and exclusive offers via email and SMS messages"

 Update the Text Label default copy to: 💬 "Subscribe to stay up to date on news and exclusive offers via email and SMS messages."

⚠️ Important: Leave the Preselect the sign-up option to disabled.
​This is important to ensure that your customers opt-in themselves.

5. Click Save


🎉 Congratulations

You can now start collecting customers' consent to receive email and SMS marketing via Marsello and Lightspeed eCommerce eSeries (Ecwid).


What is the customer experience with marketing opt-ins?

At eCommerce checkout

Under checkout, the customer will now be able to opt-in to receive marketing emails and SMS from your store by selecting the checkbox.

At checkout, customers can now opt in to receive marketing emails and SMS from your store by selecting the checkbox.

This will automatically update the customers' accept marketing preferences in both Ecwid and Marsello.

In Marsello's Customer portal

After creating a Shopify store account, customers can update their marketing preferences at any time through Marsello’s Customer Portal.

To opt in to email, SMS or both, toggle the corresponding switch under Promotional Messages to On.
