Best practices to collect SMS and email marketing opt-in from your customers via Lightspeed C-Series or via Marsello sign-up forms

To build a successful customer list that you can send campaigns to, it's mandatory to get the customer's permission before they can receive marketing emails and/or SMS from your store. Permission is required by International Law (including GDPR, TCPA, TCIA, & CCPA) and our Terms of Use.

As mentioned in the SMS Marketing Compliance Introduction and GDPR Introduction, to collect SMS and Email Marketing opt-in from your customers, there will be some changes that you need to make to your staff training processes for how to sign up new customers via Lightspeed C-Series (eComm).

Before you get started

Here are some key details to note about email and SMS marketing opt-in with Lightspeed eCom C-Series:

  • For Marsello to collect mobile numbers as subscribers for SMS messages, you will need to make a change to your Lightspeed C-Series settings, including your online checkout settings and language. Step-by-step instructions on how to do this below.

  • Lightspeed's Newsletters consent at the checkout & the customer profile will impact both email and SMS opt-in. This means that if the customer selects the consent checkbox then they are agreeing to receive promotional email and SMS messages from your store.

  • TCIA prohibits any illegal or improper promotion to persons under 18 years of age. Based on the practices and standards of your industry and community, you will need to discourage visitors under a certain age from browsing your Lightspeed C-Series store.

    • One way you can help prevent these visitors is by adding an age selection form to your storefront. Please contact the Lightspeed team for information on how to add an age-gate to your C-Series online store.

  • In addition, we advise you to always include the ability for customers to opt-out from receiving marketing. By default, Marsello automatically includes an 'unsubscribe' link on all email templates and 'Reply STOP to unsubscribe' on all SMS templates.

We also encourage you to consult a legal advisor familiar with GDPR, TCPA, and TCIA before gathering contacts or sending promotional emails or text messages.


How customers opt-in to marketing via Marsello's sign-up forms

Marsello has two different types of sign-up forms, these form templates come with a text disclaimer that lets the customer know that by submitting the form, they are opting in to receive both transactional and promotional email and SMS messages from your store.

Default text disclaimer:

*I agree to receive transactional and promotional emails and text messages (to the email address and phone number provided). Consent is not a condition to purchase. You can opt-out or change your email and SMS preferences anytime.

⚠️ Important: If you are using another app for sign-up forms, you need to update your forms to also include such a disclaimer that informs the customer that by submitting the form, they are opting-in to receive both email and SMS marketing from your store.


Capture customers marketing opt-in preference on your online store via Lightspeed C-Series

As mentioned in the Marketing Compliance Introduction, consumers have to provide “express written consent” before they can receive marketing via email or SMS.

⚠️ Important: By default, customers do not accept marketing, and they must opt-in to receive marketing through Marsello.

There may be several updates that you need to make to your C-Series store to receive full marketing opt-in consent from the customer.

The settings that you need to update are addressed in the following sections:

  • In your settings: Allow your customers to give consent to receive marketing

  • Update the consent text: Ensure customers know they are giving opt-in consent to receive email and SMS marketing.

⚠️ Important: The below changes are vital steps towards compliance. Please follow and complete each section.

In your settings: Allow your customers to give consent to receive marketing

1. In your C-Series admin navigation, go to General Settings > Advanced


2. Scroll to the Store section

3. Next to Newsletters Allow customers to subscribe to your newsletter, make sure this setting toggle is ON.

4. Click Save in the top right-hand corner

Update the consent text: Ensure customers know they are giving opt-in consent to receive email and SMS marketing

1. In your C-Series admin navigation, go to Content > Translations


2. Click Modify Translation

3. In the Override Translation pop-up enter "Subscribe" into the search box

4. Click the 'subscribe' option:

⚠️ Important: You will need to update all of the "subscribe" text options to specify that the customer is subscribing to receive email and SMS marketing.

5. Under Translation to [store language], update the text to state 'email' and 'SMS' in the opt-in consent text:

For example:

  • Stay up to date on news & offers via email and SMS.

  • Subscribe to receive news & discounts via email and SMS

6. Click Save

7. Repeat the above steps for all of the 'subscribe' content that you have available on your online store.

⚠️ Important: The checkbox must remain unselected to comply with SMS laws & regulations. The customer must opt in themselves


Your customers experience

Now, when customers create an account, visit their account page, or proceed to checkout, they'll have the opportunity to specify their marketing preferences, and they'll understand that by opting in, they're subscribing to both email and SMS marketing.

This will automatically update the customers' marketing preferences in both C-Series and Marsello.
