Capture your customers' marketing opt-in preferences
When a new customer makes an in-store purchase, it’s important that staff ask whether they’d like to join your database and receive marketing via email and SMS. Permission is required by International Law (including GDPR, TCPA, TCIA & CCPA) and our Terms of Use.
Capturing marketing consent (opt-in) means:
If you already use Marketing or SMS add-ons → you can immediately send campaigns and automations to those opted-in customers.
If you don’t yet use Marketing or SMS add-ons → you’ll be building your list now, so when you decide to upgrade, you’ll have a database ready to go from day one.
⚠️ Important: Opt-in is required
By default, customers are not subscribed to marketing. They must provide explicit consent (opt-in) before they can receive campaigns and automations through Marsello. Capturing their preferences early means you won’t miss out on future opportunities to engage them when you’re ready to start marketing.
Before you get started
Here are some key details to know about customer opt-in for marketing messages:
Consent at Checkout & Customer Profiles
Lightspeed’s Newsletters consent setting applies to both email and SMS marketing.
When a customer checks the consent box during checkout or in their profile, they are agreeing to receive promotional emails and SMS messages from your store.
Compliance with Age Restrictions (TCIA)
The Telephone Consumer Protection Act (TCPA) prohibits any illegal or improper promotion to individuals under 18 years of age.
You should take steps, based on your industry and community standards, to discourage underage visitors from browsing your Lightspeed eCom (C-Series) store.
Recommendation:
Add an age selection form (age-gate) to your storefront.

Opt-Out Options for Customers
To maintain compliance and protect customer rights, you must always provide an opt-out option:
Marsello automatically includes:
An ‘unsubscribe’ link in all email templates.
“Reply STOP to unsubscribe” in all SMS templates.
Staff Training for Opt-In Collection
To properly collect SMS and email marketing consent via Lightspeed eCom (C-Series), updates may be needed in your staff training processes:

Lightspeed's Newsletters consent at the checkout & the customer profile will impact both email and SMS opt-in. This means that if the customer selects the consent checkbox then they are agreeing to receive promotional email and SMS messages from your store.
We also encourage you to consult a legal advisor familiar with GDPR, TCPA, and TCIA before gathering contacts or sending promotional emails or text messages.
How do customers opt in to marketing through Marsello sign-up forms?
Marsello has two different types of sign-up forms: pop-up and landing page. These form templates include a text disclaimer that informs the customer that by submitting the form, they are opting in to receive both transactional and promotional emails and SMS messages from your store.
Default text disclaimer:
*I agree to receive transactional and promotional emails and text messages (to the email address and phone number provided). Consent is not a condition to purchase. You can opt out or change your email and SMS preferences anytime.
⚠️ Important: If you are using another app for sign-up forms, you need to update your forms to also include such a disclaimer that informs the customer that by submitting the form, they are opting-in to receive both email and SMS marketing from your store.
📝 Note: Customers are always in control of their marketing preferences and can opt-out at any time. All promotional messages sent through Marsello include an unsubscribe link, allowing customers to opt out whenever they choose. Alternatively, customers can request to opt out in-store at checkout or manage their preferences online through the Marsello Customer Portal.
How do I capture customer marketing opt-in preferences in Lightspeed eCom (C-Series)

To use Marsello on your Lightspeed eCom (C-Series), please enable the required sites under the Integrations page.
By default, customers do not accept marketing, and they must opt-in to receive marketing through Marsello.
The below changes are vital steps towards compliance. Please follow and complete each section.
As outlined in the Marketing Compliance Introduction, customers must give express written consent before receiving marketing emails or SMS.
To collect full marketing consent from customers in Lightspeed eCom (C-Series), you may need to update a few settings in your store including your online checkout settings and language. These updates ensure you are compliant with international laws and that your customers clearly agree to receive marketing. The key settings to review are:
The settings that you need to update are addressed in the following sections:

✔️In your settings: Allow your customers to give consent to receive marketing
1. In your C-Series admin navigation, go to General Settings > Advanced
2. Scroll to the Store section
3. Next to Newsletters Allow customers to subscribe to your newsletter, make sure this setting toggle is ON.
4. Click Save in the top right-hand corner
✔️ Update the consent text: Ensure customers know they are giving opt-in consent to receive email and SMS marketing
1. In your C-Series admin navigation, go to Content > Translations
2. Click Modify Translation
3. In the Override Translation pop-up enter "Subscribe" into the search box
4. Click the 'subscribe' option:
⚠️ Important: You will need to update all of the "subscribe" text options to specify that the customer is subscribing to receive email and SMS marketing.
5. Under Translation to [store language], update the text to state 'email' and 'SMS' in the opt-in consent text:
For example:
Stay up to date on news & offers via email and SMS.
Subscribe to receive news & discounts via email and SMS
6. Click Save
7. Repeat the above steps for all of the 'subscribe' content that you have available on your online store.
⚠️ Important: The checkbox must remain unselected to comply with SMS laws & regulations. The customer must opt in themselves

You can now start collecting customers' consent to receive email and SMS marketing via Marsello and Lightspeed eCom (C-Series).
What is the customer experience with marketing opt-ins?
At eCommerce checkout
Now, when customers create an account, visit their account page, or proceed to checkout, they'll have the opportunity to specify their marketing preferences, and they'll understand that by opting in, they're subscribing to both email and SMS marketing.

This will automatically update the customers' marketing preferences in both Lightspeed eCom (C-Series) and Marsello.
In Marsello's Customer portal
After creating a Lightspeed eCom (C-Series) store account, customers can update their marketing preferences at any time through Marsello’s Customer Portal.
To opt in to email, SMS or both, toggle the corresponding switch under Promotional Messages to On.
To opt out of email, SMS, or both, toggle the corresponding switch to Off.
